General Terms and Conditions

1. Scope of Application

For all deliveries by Digital Devices GmbH to consumers (§ 13 BGB), these General Terms and Conditions (GTC) apply.

3. Offer and Conclusion of Contract

3.1 The presentation of the products in the online shop does not constitute a legally binding offer, but an invitation to place an order. Errors excepted.

3.2 By clicking the "Order" button in the final step of the ordering process, you are placing a binding order for the goods listed on the order page. The purchase contract is concluded when we accept your order by sending an order confirmation via email immediately after receiving your order.

4. Right of Withdrawal for Consumers

(Consumers are natural persons who conclude a legal transaction for purposes that are predominantly neither their commercial nor their independent professional activity.)

Withdrawal Instructions

Right of Withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you, or a third party designated by you (who is not the carrier), take possession of the goods.

In order to exercise your right of withdrawal, you must inform us (Digital Devices GmbH, Zußdorfer Str. 67, 88271 Wilhelmsdorf, Germany, Telephone: +49 (0)7503/93000, Fax: +49 (0)7503/930050, Email: shop@digital-devices.de) of your decision to withdraw from this contract by means of a clear statement (e.g., a letter sent by post, fax, or email). You may use the withdrawal form for this purpose, although this is not mandatory. You can also complete and submit the withdrawal form or another clear statement electronically on our website (www.digital-devices.eu). If you make use of this option, we will immediately (e.g., by email) send you a confirmation of receipt of such a withdrawal.

To meet the withdrawal deadline, it is sufficient for you to send your communication regarding your exercise of the right of withdrawal before the withdrawal period expires.

Consequences of Withdrawal
If you withdraw from this contract, we will reimburse all payments we have received from you, including shipping costs (except for the additional costs arising if you chose a different type of delivery than the inexpensive standard delivery offered by us), without undue delay and at the latest within fourteen days from the day on which we received the notification of your withdrawal. For this reimbursement, we use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged fees for this reimbursement.

We may refuse reimbursement until we have received the goods back or until you have provided proof that you have returned the goods, whichever occurs first.

You must send back or hand over the goods to us immediately and in any event no later than fourteen days from the day on which you inform us about the withdrawal from this contract. The deadline is met if you send the goods before the period of fourteen days has expired.

You bear the direct costs of returning the goods.

You are only liable for any diminished value of the goods if this loss in value is due to handling of the goods that is not necessary for checking their condition, properties, and functioning.

Exclusion of the Right of Withdrawal

The right of withdrawal does not apply to contracts:

  • for the delivery of goods that are not prefabricated and for which an individual selection or determination by the consumer is decisive, or which are clearly tailored to the personal needs of the consumer,
  • for the delivery of goods that can quickly spoil or whose expiration date would be quickly exceeded,
  • for the delivery of sealed goods that are not suitable for return for health or hygiene reasons if their seal was removed after delivery,
  • for the delivery of goods that, due to their nature, are inseparably mixed with other goods after delivery,
  • for the delivery of alcoholic beverages, the price of which was agreed upon when the contract was concluded, which can, however, be delivered no earlier than 30 days after the contract conclusion and whose current value depends on fluctuations in the market over which the entrepreneur has no influence,
  • for the delivery of audio or video recordings or computer software in a sealed package if the seal was removed after delivery,
  • for the delivery of newspapers, magazines, or periodicals with the exception of subscription contracts.

5. Prices and Shipping Costs

5.1 The prices stated on the product pages include the statutory value-added tax and other price components.

5.2 Information about any additional shipping costs can be found in the "Important Customer Information" section.

6. Delivery

6.1 Delivery within the European Union is carried out by UPS, DHL, or Hermes Logistik Gruppe Deutschland GmbH.

6.2 The delivery time is up to 5 days. Any deviations will be indicated on the respective product page.

7. Payment

7.1 Payment can be made by advance payment (payment methods selectable during the ordering process) or by cash on delivery.

7.2 You are only entitled to set off your claims if your counterclaims have been legally established by a court, are undisputed, or have been acknowledged in writing by us.

7.3 You may only exercise a right of retention insofar as the claims arise from the same contractual relationship.

8. Retention of Title

Until full payment is received, the goods remain our property.

9. Alternative Dispute Resolution / Online Dispute Resolution

The European Commission provides an online dispute resolution (ODR) platform, which you can find at
https://ec.europa.eu/consumers/odr/.
Consumers have the option to use this platform for resolving their disputes.

We are not willing or obligated to participate in any dispute resolution procedure before a consumer arbitration board.
